Pfizer Inc. on Wednesday said it has ordered a $1 billion settlement with Valeant Pharmaceuticals to resolve allegations that it sold Viagra and other generic drugs for a variety of health benefits to patients under the direction of the U. S. Food and Drug Administration.
The FDA approved Viagra (sildenafil) in the United States for the treatment of erectile dysfunction. It's been sold in many other countries, including the United Kingdom and Australia, according to Pfizer. Some of the drugs were included in the generic drug category but others have been withdrawn after the FDA said they weren't covered by the agreement.
The company said it would not comment on whether Viagra was part of the settlement, citing privacy policy and the company's ongoing litigation over whether it ever received FDA approval to sell the generic drug.
Viagra has been prescribed by doctors for patients for a variety of reasons, but it has received no FDA approval. The FDA has said it is the only FDA-approved generic drug for erectile dysfunction, though it has not approved it for this purpose.
Viagra, the generic name for the popular erectile dysfunction drug, is the only one approved by the FDA to treat this condition. Pfizer has said it won't approve the generic drug for sale.
In June, a New Jersey woman filed a complaint against the company over allegations that it promoted the drug for health benefits to patients. The company has not responded to a request for comment.
Viagra and other generic drugs were approved by the FDA as a treatment for erectile dysfunction in 1994, but the FDA required a two-year process to approve the drug.
The FDA's decision, approved in April, led to the re-branding of the drug for the treatment of benign prostatic hyperplasia, a type of enlarged prostate. Some of the drugs included in the deal were approved by the FDA in May to treat pulmonary arterial hypertension.
Pfizer said it believes its decision to sell Viagra was based on information provided to The New York Times in May, which had been criticized for how the company was treating the case. The Times did not respond to a request for comment.
In an email to NPR, an unnamed FDA official said the company has no plans to appeal.
On Thursday, the New York Times' Dr. Diana R. Burnett and Dr. Scott J. Leopold, a urologist with the Cleveland Clinic, said they were not surprised by the decision. Burnett said the company has been "playing fair" to patients.
"We have not heard from any company that would take an action against us for putting Viagra and other generic drugs to patients under the care of physicians, hospitals or other health care providers who are not being paid by the FDA to prescribe it," Burnett said. "They are just not aware of the fact that it would be in their best interest to sell Viagra to people who are not being treated for erectile dysfunction."
Reed, a physician and researcher, told NPR he was surprised by the decision.
"Viagra is a prescription drug and I think that is very important," Reed said. "This was a huge deal for Pfizer and the companies and I think this was a major deal."
Flowers, the woman who filed a complaint with the FDA, said the FDA has received a "scathing" response from the company. The FDA said it did not comment on the case.
"What's happening is the company has already had an overwhelming response to the FDA, they've already had an overwhelming response," said Dr. Gloria Steinem, director of reproductive medicine at the National Institutes of Health. "The FDA is trying to get a response. I don't think they are going to make a decision on whether to move forward with that."
In a statement, the FDA said the company has received "complete and complete" written responses from women who have been taking Viagra for several years. In that response, the agency said it did not comment on its own.
Valeant said it will continue to market the drug in the United States and Europe.
Viagra will be available in pharmacies in five European countries, including Austria, France, Germany, Greece, Iceland, Netherlands and Spain.

Men in their mid-40s or early 50s were increasingly likely to be prescribed the erectile dysfunction drug Viagra. Now, thanks to a new study from a government-funded research centre, many men have taken the drug, with millions more to follow their GP. A new study by the National Institutes of Health (NIH) in the UK found that almost half of the men in their mid-40s and mid-50s took Viagra, although it was not as common as with the other treatments. Viagra is also sometimes called "the blue pill" or "the pill of choice for men," and the drug is prescribed to people with an enlarged prostate, or an inability to get or keep an erection. It is the "blue pill" for men, with more than 100 million prescriptions per year for the treatment of erectile dysfunction. The new study by the NHS, the results of which are presented this week at the British Medical Journal (BMJ), provides some insight into the use of Viagra by men in their mid-40s.
A new study in the journalPharmaceuticals and Medical Devicesfound that nearly half of men in their mid-40s and mid-50s took Viagra, though it was not as common as with other treatments. Viagra, also known as sildenafil, is the active ingredient in Viagra, and it works in the same way as the drug Cialis. But unlike the other treatments, Viagra is not a blue pill.
